Diese AGB sind sinngemäß auch gültig für die Tages-Onlinezeitug ‘VonNaftali’

1. Juristische und natürliche Personen können sich um eine Mitgliedschaft bewerben. Sie werden in Folge “Mitglieder” genannt. Jedes Mitglied anerkennt mit dem Erwerb der Mitgliedschaft (Supporter, Premium Partner, Ambassador und Abonnent) die IHRA-Working Definition of anti-Semitism und vorliegende AGB.

2. Es gibt drei Kategorien von Mitgliedschaften bei ‘awraham’: „Supporter“, „Premium Partner“ und „Ambassador“ für ‘awraham’. Die Tagesonlinezeitung ‘VonNaftali’ kennt nur eine Kategorie der Mitgliedschaft: Abonnenten.

3. „Supporter“ kann nur eine natürliche Person sein.

4. Die Mitgliedschaftsdauer bzw Abolaufzeit (VonNaftali) ist stets 12 Monate und startet immer mit dem Folgemonat. Beispiel: Ist die Mitgliedschaft am 15. Juli abgeschlossen worden, dann werden die 12 Monate ab dem 1. August gerechnet. Es gibt Promoaktionen in festesetzten Zeiträumen die Mitgliedschaft/Abonnierung auf Lebenszeit anbietet. Dies meint, das Abo läuft solange, wie VonNaftali existiert aka “lebt”. Refundierung ausgeschlossen.

5. Die Mitgliedschaft kann ohne Angaben von Gründen abgelehnt werden. Es besteht kein wie immer gearteter Anspruch auf Mitgliedschaft. Aktuell steht nur diese Landingpage und die Tages-Onlinezeitung ‘VonNaftali’ zur Verfügung. Die Subskriptionsgebühr für 12 Monaten ist in der Mitgliedschaftsgebühr inkludiert, solange ‘awraham’ nicht online ist.

6. Die Mitgliedschaft kann von Awraham Corp. jederzeit gekündigt werden, wenn ein Verstoß gegen die IHRA-Working Definition of Anti-Semitism vorliegt. Alle allfälligen Mitgliedschaftsgebühren werden nicht refundiert und der Account und die Präsenz werden geschlossen. Der Ausschluss kann allgemein bekannt gegeben werden. Das Mitglied verzichtet auf den Rechtsweg. Ein Ausschluss samt entsprechenden Dokumenten kann dem ‘Advisory Board Against Antisemitism’ von awraham vorgelegt werden. Das Advisory Board beschließt einstimmig und endgültig über Ausschluss. Der Board wird von Awraham Corp nominiert.

7. Das Mitglied versichert, dass es für alle Posts, Publikationen, Bilder, Videos, die es auf awraham und VonNaftali verbreitet, über die entsprechenden Rechte (Copyright, Urheberrecht etc.) verfügt bzw. eingeholt hat und auch die entsprechenden Angaben setzt. Mitglieder sind zudem presserechtlich verantwortlich für ihre Blogsund Kommentare auf awraham und VonNaftali. Das Mitglied hält in jedem Fall awraham, VonNaftali und die Awraham Corp. schad- und klaglos. Abraham Corp erhebt keinerlei Ansprüche auf Copyright von Postings etc. von Mitgliedern.

8. Das Mitglied allein ist für seine Postings verantwortlich und haftbar zu machen. Das Mitglied haltet awraham, von Naftali und die Awraham Corp. schad- und klaglos. Das Mitglied stimmt zu, sein Passwort und User-ID nicht an Dritte zu vergeben (sei es gewerblich oder privat). Das Mitglied stimmt einer Strafgebühr von USD 1.000 zu und wird dauerhaft von allen Medienageboten von Awraham Corp ausgeschlossen.

9. Die Mitgliedschaft kann jederzeit per Mail an: naftali.hirschlATawraham.com jährlich gekündigt werden. Beispiel: Sie haben am 15. April 2022 Ihre Mitgliedschaft beantragt und genehmigt erhalten. Sie kündigen am 15. Juli 2022. Ihre Mitgliedschaft erlischt mit dem 15. April 2023.

10. Sollte spätestens bis 3 Monate vor Ablauf der Mitgliedschaft keine schriftliche Kündigung per Mail an: naftali.hirschlATawraham.com unter Angabe Ihrer Mitgliedschaftsnummer und Verwendung Ihrer Anmeldungsemail eingehen, verlängert sich die Mitgliedschaft automatisch um weitere 12 Monate. Die neue Mitgliedschaftsgebühr kann aufgrund der aktuellen Inflationsrate (USA) und/oder neuer Feature angepasst werden. In diesem Fall gewähren wir ein 14-tägiges Rücktrittsrecht (ab Datum Rechnung) von der Mitgliedschaft. Machen Sie innerhalb von 14 Tagen von diesem Recht keinen Gebrauch, haben Sie dem neuen Entgelt und Gebühren zugestimmt.

11. Sollten innerhalb Ihrer Mitgliedschaftsperiode kostenpflichtige neue Features auf awraham eingespielt werden, so können Sie diese bis zum Ablauf der aktuellen Mitgliedschaft kostenfrei nutzen. Mit Verlängerung der Mitgliedschaft stimmen Sie dann der neuen Mitgliedschaftsgebühr zu. Beispiel: Sie wurden Mitglied am 15. April 2022, ein neues Feature wurde am 15. Mai 2022 freigeschalten (z.B. Marktplatz), dann können Sie den Marktplatz bis zum Ende Ihrer Mitgliedschaft (15. April 2023) kostenfrei nutzen.

12. Mitglieder haben verschiedene Nutzungsrechte als Mitglieder, die auf „Memberships of awarham“ beschrieben sind. Diese Rubrik gibt auch Auskunft über die aktuellen Preise.

13. Der Zugang zu ’awraham’ bzw VonNaftali wird erst nach vollständigem Ausgleich der Mitgliedschaftsgebühr gewährt. Die Mitgliedschaftsgebühr ist ausschließlich in USD (US-Dollar) zu entrichten. Alle Bankspesenkosten trägt zu 100% das Mitglied.

14. Auf awraham und VonNaftali gilt das Recht auf freie Meinungsäußerung im Sinne einschlägiger Schiedssprüche des US-Supreme Court.

15. Daten von Mitgliedern werden nur für Verwaltungszwecke (Mitgliedschaft) elektronisch verwaltet. Die Daten werden von der Awraham Corp. nicht an Dritte weitergegeben. Awraham Corp. betreibt kein Datamining. awraham und VonNaftali betreiben keinTracking, Cookies für Marketing, frei von Bannerwerbung, werblichen Pop-ups und ähnlichen Formaten sowie wird kein mathematischer Algorithmus zur Organisation der Timeline verwendet. Auf awraham und VonNaftali gibt es „Medienkooperationen“, die als solche ausgezeichnet werden. Funktionale Cookies werden nach technischen Maßgaben für ein optimales Usererlebnis und für den Zahlungsverkehr (STRIPE) eingesetzt. Wir können aber Tracking, Datamining etc durch Dritte nicht ausschließen, da Links in Artikel zu solchen Anbietern führen können (zB Link zu Youtube oder Twitter).

16. Mitglieder, die ihre Postings, Blogs etc dahingehend manipulieren, dass es zu Datamining, Tracking etc kommt, werden dauerhaft von awraham und VonNaftali ausgeschlossen. Mitglieder, die solche Maßnahmen vornehmen, Privatspähre von Usern verletzten oder illegalen Strukturvertrieb, MLM und Ponzi-Schemata betreiben sowie anti-semitische Propaganda zustimmend verbreiten, werden dauerhaft ausgeschlossen. Die Mitgliedsschaftsgebühr wird nicht refundiert.

17. Werbliche Angebote für Produkte, Immobilien und Dienstleistungen – ausschließlich B2B – sind im Rahmen der allgemeinen Gesetze und Regulierungen gestattet und erwünscht. awraham, VonNaftali und Awraham Corp. übernehmen dafür keinerlei Haftung, Kontrolle und das Mitglied hält awraham und die Awraham Corp. schad- und klaglos. Awraham Corp. lehnt jede Provisionierung etc ab. awraham bzw VonNaftali sind Plattformen, die sich durch Mitgliedschaftsgebühren und ausgewiesenen Medienkooperationen finanzieren. Keine Bannerwerbung oder ähnliches durch google&co. VonNaftali, awraham stellen Unternehmen vor, die nach Investoren suchen. Die Darstellung und Bericht über solche Unternehmen stellt keinerlei Kaufempfehlung, beratung oder ähnliches dar. Die Entscheidung zu investieren, ist alleine die des Investors. Investitionen sind Risken und können zum Verlust führen. Für Übersetzungen durch VonNaftali wird keine Gewährleistung übernommen.

18. Das Angebot, die Verfügbarkeit und Preisstabilität können nicht zu 100% garantiert werden und können Änderungen unterworfen sein aufgrund höherer Umstände, die da sind: Inflation/Deflation, Wirtschaftskrise (Rezession), Krieg, Aufruhr, Seuchen, Pandemie oder Umweltkatastrophen. Das Mitglied verzichtet auf jegliche Kompensationsansprüche.

19. Awraham Corp. bietet weitere Dienstleistungen an, die nicht durch die Mitgliedschaftsgebühr gedeckt sind, wie z.B. Erstellen von Blogs, Verfassen von White Papers, Artikeln, Medienkooprationen, Research und ähnliche Dienstleistungen. Diese weiteren Dienstleistungen verfügen über eigene AGBs, die gegenüber dem Mitglied Ambassador kommuniziert werden.

20. Für Berichte, Meldungen, Kommentare etc auf der Tages-Online-Zeitung auf awraham bzw VonNaftali übernimmt awraham, VonNaftali und Awraham Corp. keine Gewährleistung.

21. awraham, VonNaftali und Awraham Corp. haften nicht für die Postings, Angebote, Blogs oder anderen Publikationen der Mitglieder. Mitglieder sind für ihre Blogs presserechtlich verantwortlich und haben dazu ein geeignetes Impressum nach den Rechtsvorschriften ihres Wohnsitzes zu führen.

22. Die Verwendung von awraham unterliegt dem fair use in Bezug auf Datenvolumen. Es kann daher zu Drosselungen kommen. Fragen zur Verwendung, fair use, Mechaniken etc. von awraham werden in den fortlaufend gepflegten F&Q beantwortet.

23. Die Systemnavigation hat als default-Sprache Englisch. Weitere Sprachen werden folgen.

24. 10 % der jährlichen Mitgliedsbeiträge spendet die Awraham Corp an den „Awraham Award“. Die erste Abraham Award Verleihung wird 2024 stattfinden. Hernach jährlich.

25. Die Mitgliedschaft Premium Partner und Ambassador berechtigt nur zum Eintritt zur Veranstaltung “Awraham Award”. Anreise, Koste, Logie, Aufenthalt, Spesen und alle weitere Ausgaben trägt jedes Mitglied für sich selbst.

26. Alle Preise sind in US-Dollar (USD) und exkl. MwSt., sofern anwendbar, angegeben.

27. Die Rechnung zur Mitgliedschaftsgebühr ist innerhalb von 1 Tag (Kalendertag) auf das Konto der Awraham Corp. auszugleichen. Es wird je Mahnschritt eine Gebühr von 100 USD vereinbart, zahlbar durch das säumige Mitglied. Es sind drei Mahnschritte vorgesehen. Dann wird es dem Inkasso/Gericht übergeben.

28. Sollte das Projekt awraham nicht innert 12 Monaten starten (bis November 2023) werden die überwiesenen Mitgliedschaftsgebühren abzüglich der Abogebühr für die Tages-OnlineZeitung ‘VonNaftali’ (in Höhe von 29,90 USD) der KKL zu 100% überwiesen. Ein Nachweis wird per Mail zugestellt.

29. Allgemeine Schlußbestimmung: awraham, VonNaftali und Awraham Corps (in Folge awraham) schließen im größtmöglichen gesetzlich zulässigen Umfang alle ausdrücklichen oder stillschweigenden Gewährleistungen aus, einschließlich, aber nicht beschränkt auf stillschweigende Gewährleistungen der Marktgängigkeit, zufriedenstellenden Qualität oder Eignung der Informationen für einen bestimmten Zweck. awraham haftet nicht für Schäden jeglicher Art, die sich aus der Nutzung dieser Website und ihrer Inhalte in Bezug auf deren Richtigkeit, Genauigkeit, Aktualität, Zuverlässigkeit oder auf andere Weise ergeben.Obwohl awraham angemessene Anstrengungen unternimmt, um zuverlässige Inhalte von Dritten zu erhalten, übernimmt awraham keine Garantie für die Richtigkeit oder Billigung der Ansichten oder Meinungen von Inhaltsanbietern Dritter. awraham kann auf andere Internetseiten verweisen, die für Benutzer von Interesse sein könnten; awraham billigt oder übernimmt jedoch keine Verantwortung für den Inhalt dieser anderen Websites. Terms and Conditions for Memberships at “awraham | The 1st Social Media News Network: Israel, Abraham Accords States, USA & EU | Business, Innovation&Sustainability” (hereinafter abbreviated to: awraham). This terms also apply mutatis mutandis to the online-daily ‘VonNaftali‘.

awraham and ‘VonNaftali’ are medias presented and owned by Awraham Corp. based in the United States.

1. Legal and natural persons can apply for membership.They are hereinafter referred to as “Members”. With the acquisition of membership (Supporter, Premium Partner, Ambassador and Subscriber), each member recognizes the IHRA-Working Definition of anti-Semitism and these General Terms and Conditions.

2. There are three categories of membership for ‘awraham’: “Supporter”, “Premium Partner” and “Ambassador”. The daily online newspaper ‘VonNaftali’ has only one category of membership: subscribers.

3. “Supporter” can only be a natural person.

4. The membership period res subscription period (VonNaftali) is always 12 months and always starts with the following month. Example: If the membership was completed on July 15th, the 12 months are calculated from August 1st. There are promotions at fixed time periods that offer lifetime membership/subscription. This means the subscription runs as long as VonNaftali exists aka “lives”. No refunding.

5. Membership can be rejected without giving reasons. There is no entitlement to membership whatsoever. Only this landing page is currently availabl and the dialy-online ‘VonNaftali’ for which the subscription is included as long as ‘awraham’ is not operative.

6. A Membership can be terminated by Awraham Corp. at any time for violating the IHRA Working Definition of anti-Semitism. Any membership fees will not be refunded and the account and presence will be closed. The exclusion will be publicly announced. The member waives legal recourse. A disqualification and supporting documentation may be submitted to the awraham Advisory Board Against Antisemitism. The Advisory Board decides unanimously and finally on the exclusion. The Board is nominated by Awraham Corp.

7. The member assures that he or she has the appropriate rights (copyright etc) for all posts, blogs, publications, images, videos that he/she distributes on awraham and that he/she has also provided the appropriate information. Memebers are also responsible under press law for their blogs, commmets on awraham and VonNaftali. In any case, the member holds awraham, VonNaftali and the Awraham Corp. harmless and free of any legal and non-legal complaints. Abraham Corp claims no copyright on member postings etc.

8. The member alone is responsible and liable for his postings. The member holds awraham and the awraham corp. harmless and free of any legal and non-legal complaints. The member agrees not to give his password and user ID to third parties (whether commercial or private). Member agrees to pay a $1,000 fine and be permanently banned from all Awraham Corp media offerings.

9. Membership can be canceled at any time by sending an email to: naftali.hirschlATawraham.com Example: You applied for membership on April 15, 2022 and received approval. You cancel on July 15, 2022. Your membership expires on April 15, 2023.

10. If no written cancellation is received by e-mail at least 3 months before the membership expires at: naftali.hirschlATawraham.com, stating your membership number and using your registration e-mail, the membership will be automatically extended by a further 12 months. The new membership fee can be adjusted for the current inflation rate (USA) and due to expanded features. In that case we grant for 14 days (day of invoice) a right to withdraw from membership. If you do not exercise this right within 14 days, you have agreed to the new fee.

11. If new paid features are installed on awraham during your membership period, you can use them free of charge until the current membership expires. By automatically extentation of the membership, you then agree to the new membership fee. Example: You became a member on April 15, 2022, a new feature was activated on May 15, 2022 (e.g. marketplace), then you can use the marketplace free of charge until the end of your membership (April 15, 2023).

12. Members have different usage rights as described on the page ‘Memberships of awarham’. This section also provides information about the current prices, which currently (as of August 2022) applies. All figures in US dollars (USD) and excl. VAT (if applicable):

13. Access to ‘awraham’ will only be granted after full settlement of the membership fee. The membership fee is payable in USD (United States Dollars) only. All bank charges are 100% borne by the member.

14. The right to freedom of expression in accordance with relevant decisions of the US Supreme Court applies to awraham and VonNaftali.

15. Members’ data is only managed electronically for administrative purposes (membership). Data is provided by Awraham Corp. not passed on to third parties. Avraham Corp. does not do data mining. awraham and VonNaftali do not operate tracking, cookies for marketing, free of banner ads, promotional pop-ups and similar formats, and do not use any mathematical algorithm to organize the timeline. There are “media collaborations” on awraham and VonNaftali that are labeled as such. Functional cookies are used according to technical specifications for an optimal user experience and for payment transactions (STRIPE). However, we cannot rule out third-party tracking, data mining, etc., since links in articles can lead to such providers (e.g. link to YouTube or Twitter).

16. Members who manipulate their postings, blogs etc to the point of data mining, tracking etc will be permanently banned from awraham and VonNaftali. Members who take such measures, violate the privacy of users or operate illegal structured sales, MLM and Ponzi schemes and spread anti-Semitic propaganda approvingly, will be permanently excluded. The membership fee will not be refunded.

17. Promotional offers for products, real estate and services – exclusively B2B – are permitted and desired within the framework of general laws and regulations. awraham, VonNaftali and Awraham Corp. shall have no liability, control, and the member holds awraham, VonNaftali and the Awraham Corp. harmless and free of any legal and non-legal complaints. Awraham Corp. rejects any provisioning etc. awraham and VonNaftali are platforms funded by membership fees and marked media collaborations. No ADs by third parties (like Youtube, google&co). VonNaftali and awraham introduce companies looking for investors. The presentation and report on such companies does not represent any purchase recommendation, advice or similar. The decision to invest is solely that of the investor. Investments are risks and can lead to loss. For any translations by VonNaftali no warrant in any form is given.

18. The offer, availability and price stability cannot be 100% guaranteed and may be subject to change due to major circumstances such as: inflation/deflation, economic crisis (recession), war, riots or environmental disasters. The member waives any claims for compensation.

19. Awraham Corp. offers other services not covered by the membership fee, such as creating blogs, writing white papers, articles, media collaborations, research, and similar services. These other services have their own terms and conditions, which are communicated to the member Ambassador.

20. For reports, announcements, comments etc. on the daily online newspaper on awraham, VonNaftali and Awraham Corp. no guarantee for the correctness.

21. awraham, VonNaftal and Awraham corp. are not liable for the postings, offers, blogs or other publications of the members. Members are responsible for their blogs under press law and must provide a suitable imprint in accordance with the legal provisions of their place of residence. In any case, the member holds awraham, VonNaftali and the Awraham Corp. harmless and free of any legal and non-legal complaints.

22. The use of awraham is subject to fair use with regard to data volume. Turning down can therefore occur. Questions about the use, fair use, mechanics etc. of awraham are answered in the continuously updated F&Q.

23. The system navigation has English as the default language. Other languages will follow.

24. Awraham Corp donates 10% of annual membership fees to the Awraham Awards. The first Abraham Award ceremony will take place in 2024. Thereafter annually.

25. Premium Partner and Ambassador membership only entitles entry to the “Awraham Award” event. Each member bears their own travel expenses, lodging, accommodation, expenses and all other expenses on its own.

26. All prices are in US Dollars (USD) and exclude VAT.

27. The invoice for the membership fee is to be paid to Awraham Corp.’s account within 1 days (calendar day) to balance. A fee of USD 100 per dunning step will be agreed, payable by the defaulting member. There are three dunning steps. Then it is handed over to the collection agency/court.

28. If the awraham project does not start within 12 months (by November 2023), 100% of the membership fees minus the subscriberfee for the online-daily ‘VonNaftali’ (29,90 USD) will be transferred to KKL. Proof will be sent by email.

29.
