During its deliberations on the bill ahead of its first reading, the committee decided to add to the foundations of the offence a requirement of intent, similar to the one that exists in the law prohibiting Holocaust denial, and added protection for publications made for a legitimate purpose, for example, within a legal proceeding, similarly to the provisions about the offence of consumption of terrorist content in the Counter-Terrorism Law.

During the deliberations, it was agreed to broaden the definition of the events of the massacre that may not be denied – “events of the massacre,” without going into detail. In addition, since the bill notes that the massacre was organized and intentional, the offence of diminishing the scale of the massacre was removed from the proposal.
The bill further stipulates that any indictment for offences that are specified in it will be filed by the Attorney General, or with the Attorney General’s consent, as is the case with the law prohibiting Holocaust denial.
Committee Chair MK Rothman said “I hope this law will always remain unenforced and that we will not witness such phenomena, certainly not without our midst. This law is a significant statement, and this is why it was approved here unanimously and without reservations.”
